In North Carolina workers' compensation cases that involve a 75% or more loss of use of the back, the injured worker shall be deemed to have suffered, “total industrial disability” and compensated as for a total loss of use of the back. In this case, the worker will receive their comp rate for the rest of their life or until they are able to find “suitable” employment earning the same or greater wages that they were earning at the time of the back injury.
