An Illinois woman has filed suit against a Wal-Mart in Highland, Illinois on June 23 in the Circuit Court of Madison County, Illinois after she sustained personal injuries alleging that the property was not kept in a condition that was reasonably safe.
According to Maureen Neal, on November 5, 2007, she was at the Wal-Mart to assist one of her students in unloading merchandise from a Wal-Mart trailer when a door to the trailer suddenly swung closed on her leg and foot with no warning.
According to Neal, she was owed a duty by Wal-Mart to exercise ordinary care in order to insure that the property was reasonably safe for those lawfully on the property to use.
Neal also alleges negligence on the part of Wal-Mart due to its failure to properly secure the doors to the trailer and failure to warn her of the trailer doors not being secure.
Neal alleges that because of the injury she has been and will continue to be caused to incur medical expenses, lose income, sustain pain and suffering, and suffer from a disability. She seeks damages in excess of $100,000 plus costs.
