A woman from Beaumont, Texas has filed suit against Louise Hill and Hills Children Nursery individually and on behalf of her 19-month-old daughter, claiming that her daughter sustained serious personal injuries after falling while at the day care.
In the suit filed by Brandace Dabney on November 21 in Jefferson County, Texas District Court, she claims that her daughter, Jasmine Dabney, was at Hills Children Nursery on December 1, 2006 when she fell because of the day care’s “failure and/or refusal to provide adequate care, employees, supervision, or safeguards.”
The suit alleges that the fall caused Jasmine to suffer “severe and traumatic” injuries to the head, neck, and body. Her mother claims that she also incurred medical costs and suffered past and future physical pain and suffering, mental anguish, physical impairment, and disfigurement.
The suit alleges that the day care and its owner, Hill, breached their duty to keep the premises safe through failure to maintain an adequate number of staff or employees, maintain an adequate number of trained staff or employees, and require the staff or employees to use size-appropriate high chairs.
