A woman from Port Arthur, Texas has filed a personal injury suit against H.E. Butt Grocery Co., claiming that she slipped on water and fell into a display full of glass jars of hot sauce while shopping at H.E.B. Pantry.
According to the suit she filed on December 18 in Jefferson County, Texas District Court, Darlene McClain was a customer at the Port Arthur store when she slipped in a puddle of water on the floor that had originated from a drip in the ceiling. The suit says the slip caused her to fall into a display of hot sauce, which caused her to sustain injuries to her eyes, face, and left hip and side.
McClain claims that her injuries caused her to incur medical expenses and suffer lost earnings, physical pain, mental anguish, physical disfigurement, and physical impairment.
The suit alleges negligence on the part of H.E. Butt Grocery Co. for creation of the dangerous condition, failure to provide a safe place to walk, failure to inspect the premises, failure to warn, failure to guard against the dangerous condition, failure to keep the walkway free of water, and failure to remedy the leaking ceiling. McClain seeks unspecified damages.
