Illinois resident Deborah LoDuca has filed suit against Wal-Mart and Sam’s Club for the personal injuries she claims she sustained while trying to sit on an office chair that had been displayed at a store in O’Fallon, Illinois.

According to a complaint filed in the Circuit Court of St. Clair County, Illinois on August 29, as LoDuca was lowering herself onto the chair at the Sam’s Club store on August 1, 2007, the chair malfunctioned.


According to the suit, the defendants are negligent through their failure to remedy the chair’s dangerous condition when they had knowledge or should have had knowledge of the condition and the unreasonable risk it created.

LoDuca also alleges that the defendants did not properly assemble the chair and failed to warn her of the dangerous condition.


LoDuca claims that she sustained injuries to her lower back, bodily pain and anguish, loss of a normal life, and medical expenses. She seeks damages in excess of $50,000.
