How Is Fault Determined After a Multi-Vehicle Crash in Durham, NC?

Fault after a multi-vehicle crash in Durham is determined by reviewing each driver’s actions and whether those actions caused the collision. Several drivers may share responsibility, but being involved does not automatically mean someone is at fault.

When drivers give different accounts, photographs, crash reports, witness statements, and available video can help clarify what happened. These details may show how the vehicles moved before the collision and the order in which they struck one another.

Because North Carolina follows contributory negligence, your own carelessness can prevent you from recovering damages if it contributed to your injuries. This rule can apply even when you share only a small amount of fault, although exceptions may apply.

If a commercial truck is involved, the trucking company may also be responsible. A claim may involve a driver’s actions while working for the company or problems with truck maintenance or cargo loading that helped cause the collision.

After a serious crash, medical bills and time away from work can make everyday expenses harder to manage. Your claim may cover those losses, along with pain and suffering and future treatment you need because of the crash.

In most cases, you have three years to file a personal injury lawsuit in North Carolina. If you miss that deadline, you could lose your right to recover compensation through a lawsuit.

While several insurers may be involved, a truck accident lawyer can help determine which policies may cover your losses. An attorney can also handle communication with those companies so you can focus on your recovery.
