A man from Oklahoma has filed suit against the operator of a tourist attraction in Galveston, Texas claiming that he sustained personal injuries after a collision with another person on a water slide last summer.
According to the suit he filed on January 15 in Texas’ Galveston County District Court, Faisal Wasi was on the water slide at Moody Gardens’ Palm Beach water park on May 24. He claims that he was disembarking from the slide when he was struck behind the person coming down the slide behind him.
The suit alleges that Moody Gardens failed to provide safeguards on the water slide.
The suit says that Wasi had come down the slide at the direction of the personnel at the top of the slide, but before he could exit at the bottom, another person was allowed to come down and struck him, causing him to suffer injury.
The suit alleges negligence on the part of Moody Gardens for failure to properly train its personnel to maintain a proper lookout, failure to maintain the slide in a safe condition, and failure to ensure that he had left at the base of the slide before allowing another person to go down.
The person who allegedly injured Wasi was not named as a defendant.
The suit did not specify Wasi’s injuries, but says that he was rendered unable to work. He seeks damages for lost earning capacity, lost wages, pain and suffering, disfigurement and impairment, mental anguish, and medical expenses.
