11/17/2008At the age of 52, Sidney was laid off after the company doctor discovered that he had cirrhosis of the liver and emphysema. However, his application for benefits from Social Security disability was denied by the Social Security Administration.
He was told by the case worker that he was unable to work because he drank excessively. He said that if Sidney would listen to the advice of his doctor and stop drinking, that he would be able to work.
Sidney responded by taking the Social Security officer to court, arguing that he is an alcoholic and unable to control his alcohol use.
The judge ruled in Sidney’s favor, saying that alcoholics were entitled to receive benefits from Social Security disability as long as an effort is made to treat the disease. The judge explained that to get a chronic alcoholic back to work, extensive medical and psychological treatment is necessary.
