A former employee of Matrix Corp. has filed suit against the company alleging that after he sustained personal injuries while working, he was fired for claiming workers’ compensation benefits.
According to the complaint filed in Jefferson County, Texas District Court on December 2, Roy Ariola sustained personal injuries during the course of his employment on November 1, 2006 and was taken to the company doctor, who placed him on light duty.
The suit claims that Matrix terminated Ariola after informing him that there were no light duty positions. The suit states that the firing was an “act of retaliation” against Ariola because he pursued workers’ compensation.
Ariola claims that his termination has caused him emotional pain and suffering, inconvenience, mental anguish, and lost enjoyment of life. He seeks a judgment in the minimum jurisdictional limit, pre- and post- judgment interest, costs, and other relief to which he may be entitled.
