How Do Wrongful Death Claims Involving Children Work in Durham, NC?

A wrongful death claim involving a child in Durham is generally brought by the personal representative of the child’s estate. The claim can seek compensation for losses caused by the death, including certain medical and funeral expenses and the loss of the child’s care, companionship, and guidance.

When a family begins the process, the estate may first need a personal representative who has authority to bring the claim. That person handles the legal action on behalf of those entitled to receive any recovery under North Carolina law.

Because the claim involves a child, North Carolina law may allow the family to seek compensation for the loss of the child’s care, companionship, comfort, guidance, and other contributions.

After the estate is established, the family may also need to identify the insurance coverage connected to the crash. The available policies can affect how the claim proceeds.

If questions arise about fault, investigators and insurers may review the driver’s actions, roadway circumstances, vehicle evidence, photographs, video, and other available information. Establishing responsibility is especially important before the estate decides how to move forward.

Because North Carolina generally gives families two years from the date of death to file a wrongful death lawsuit, timing also matters. Waiting too long can affect the estate’s ability to bring the case.

During the claims process, a wrongful death lawyer can help the personal representative understand filing requirements, review available insurance, and address disputes about responsibility or losses. An attorney can also explain how any recovery may be handled.
