An Ankle Fracture Leads to Pretrial Settlement

The plaintiff, Marcelene Lemar of Fayetteville, and the defendant Barbara Zuiderent were both driving their vehicles on intersecting streets. The defendant stopped at a stop sign and then pulled into the intersection where she struck the plaintiff.

The plaintiff said that defendant failed to yield the right-of-way and keep a proper lookout. The plaintiff claimed she had an ankle fracture as a direct result of the accident.

The alleged injuries were a fracture of the right ankle that required open reduction with internal fixation. Mrs. Lemar also claimed $33,000 in past medical bills.

The it was settled in June 2010 for $80,000.
