A 2-year-old boy was killed October 15 while riding in a van with his grandparents, Millard and Grace Bishop, in Franklin County. The van was traveling west on N.C. 98 at the time an empty tractor-trailer was traveling east.
Robert D. Griffin, Jr., of Oxford stated that the brakes locked up on the truck, causing it to run off the road. Griffin over-corrected, and his truck crossed left of the centerline, hitting the side of the van. Local news reports claim Griffin failed to secure the trailer properly.
Some truck accidents involve an at-fault driver who is charged with misdemeanor death by motor vehicle. These fatal cases are a segment of accident cases that generally involve wrongful death lawsuits. One of the factors typically discussed in wrongful death cases is whether the at-fault party was negligence or grossly negligent. North Carolina injury attorney Brent Adams explains more about the difference between negligence and gross negligence.
