Woman Files Suit After Tangle With Ladder

The general manager of a beachfront property in Galveston, Texas has filed a personal injury suit against a roofing business and a general contractor, alleging a ladder fell on her last year.

According to the suit filed by Diana Mae Gamez on March 5 in Texas’ Galveston County District Court, DSC Properties Inc. and David Morgan Roofing allowed said ladder to slip off the roof of Miller’s Landing and land on her foot and ankle on February 11, 2008.

When the alleged incident occurred, the defendants were performing repairs on the restaurant.

Gamez claims that as she was making her way into the building after a moment outdoors, she heard a worker yell for her to “look out.” She turned and saw the ladder dangle off the roof and tried to move out of the way, but it was no use.

The suit said that despite attempting to move out of the way, Gamez was unable to avoid the ladder and became entangled with it, causing her severe injuries to her foot and ankle.

The complaint links the ladder to Morgan Roofing and says that DSC Properties was the contractor for the work.

The suit alleges negligence on the part of the defendants for failure to properly inspect and maintain the premises, failure to provide adequate warnings of markings, failure to secure the area where Gamez was standing, and failure to supervise the workers.

Gamez seeks damages for loss of wages, pain and suffering, mental anguish, and medical expenses and has demanded a trial by jury.
