A woman from St. Clair County, Illinois has filed suit against a St. Clair County man claiming that she sustained personal injuries in a rear-end collision.
According to the suit she filed in St. Clair County Circuit Court on January 7, Kirsten Borger was a passenger in a 2001 Chrysler Sebring on August 12, 2006 when the crash took place.
According to the suit, the Sebring was stopped at a red light at the time of the crash. The driver of a 2000 GMC Sonoma, Derek Engel, failed to stop in time and collided with the rear of the Sebring, according to the suit.
Borger claims that the collision caused her to become sick, sore, lame, disordered, and disabled and suffer injuries to her neck, shoulder, low shoulder, low back, and knee. She also claims to have incurred medical expenses, suffered a disability, and lost money due to lost wages.
The suit alleges negligence on the part of Engel for violation of the duty of care owed to Borger, failure to maintain proper control of his vehicle, failure to maintain a proper lookout, driving at an excessive speed, failure to reduce his speed in order to avoid injuring others, driving in a manner that resulted in his vehicle colliding with another, failure to brake, failure to obey the stoplight, and following another vehicle too closely.
Borger seeks damages in excess of $50,000, plus costs.
