
According to a personal injury suit he filed, Steven Rank was attempting to cool off on a hot Texas summer day in August of 2008 by sliding down the water slide into the pool at a fitness center.
However, Rank says he never reached the pool because he struck his head on an unpadded metal crossbar located right above the slide’s entrance.
On June 29, Rank filed suit against Life Time Fitness Inc. in the 296th judicial district of Collin County, Texas. On August 25, Life Time Fitness removed the suit to federal court in the Sherman Division of the Eastern District of Texas.
Rank alleges negligence on the part of Life Time Fitness for failure to inspect and maintain the premises, failure to ensure that the premises was in a reasonably safe condition that was free from hazards, failure to correct the unreasonable dangerous condition, failure to properly train its employees, and failure to implement proper policies, rules, or procedures to ensure the safety of the premises.
Rank seeks damages for physical pain and suffering and impairment, mental anguish and medical costs. He has requested a jury trial.
