
A man has filed a personal injury suit against the driver he claims rear-ended the trailer he was driving on the interstate.
According to the suit Victor and Theresa Berthelsdorf filed in Illinois’ Madison County Circuit against Dynamic Transit Company, Everest Trucking Company, and Arlando Anderson on August 21, Victor Berthelsdorf was westbound on Interstate 70 in Colorado on April 26, 2008 when Anderson, also westbound, struck the rear of Berthelsdorf’s trailer. The suit also says that Theresa Berthelsdorf was a passenger in the vehicle at the time of the crash.
The suit says Arlando was driving as part of his employment for Dynamic Transit and Everest Trucking.
The Berthelsdorfs claim that the accident has caused them to experience injuries and property damage.
The suit alleges negligence on the part of Anderson for failure to maintain a proper lookout, driving at an excessive speed, and driving while either being sleepy under the influence of drugs or alcohol.
The two-count suit seeks compensatory damages in excess of $100,000.
