Man Files Suit Against GM, Seatbelt Manufacturer, and Driver After Wife Killed In Crash

A man has filed a wrongful death suit against General Motors Company, an unnamed seatbelt corporation, and a woman for the fatal personal injuries his wife suffered in a vehicular accident.

 

According to the suit Miguel A. Hernandez filed on October 13 in West Virginia’s Putnam Circuit Court, he was eastbound on Interstate 64 in a 1995 GMC Safari minivan with his wife, Isabel Calderon Alejo, on when the July 5 crash occurred.

 

According to the suit, the driver of the other vehicle, Ashley D. Burgess, was negligent and careless by following Hernandez and Alejo’s vehicle too closely and without regard for the vehicle’s speed, traffic, and the highway’s condition.

 

Burgess rear-ended the couple’s vehicle, causing it to skid off the road and overturn.

 

Hernandez claims the accident caused property damage to the minivan and personal injuries to him. The suit claims Alejo was ejected from the vehicle because her seat belt broke when the vehicle overturned. She died from the injuries she suffered.

 

According to Hernandez, the injuries he suffered have caused and continue to cause him to experience physical and mental pain and anguish, nervousness, anxiety, lost wages, diminished ability to enjoy life, and other discomforts and pain and incur medical expenses.

 

The suit also claims that Alejo’s death has deprived Hernandez of services, affection, solace, comfort, companionship, society, assistance, and consortium.

 

The suit alleges negligence on the part of GMC and the corporation that manufactured the seat belt component parts assembled in his vehicle for allegedly knowing or having reason to know that the vehicle would be used without inspection of defects.

 

Hernandez has filed suit both individually and as administrator of Alejo’s Estate for compensatory and punitive damages.

I also has injured in a similar sitution. the seatbelt was the cause of my injuries, but look out they "Try not to stand" behind "their product". There will be many road blocks but don't give up , That's what they are hopeing for.
