Man Files Suit Against Employer After Fall From Broken Ladder

A man has filed a personal injury suit against a former employer, alleging that he suffered injuries in a fall from a broken ladder.

According to the suit filed in West Virginia’s Putnam County Circuit Court on February 19 by Travis Holstein, he was working as a laborer for Tasty Blend Foods in its production plant in Fraziers Bottom on July 16, 2007 when the incident occurred.

Holstein claims that at the time he was cleaning out bins used for the storage of food products produced by the company, work which required that he use a ladder.

Holstein said the ladder he used had a brace support that had broken and had been sent to maintenance for repairs. However, Holstein claims, the ladder was taken from maintenance by the plant manager before repairs could be conducted and placed back into use in the plant shop.

According to Holstein, he climbed the ladder, which broke, causing him to plummet to the floor. He says the fall resulted in severe and permanent injuries, including, but not limited to, fractures to his right radius and elbow and a contusion to his right wrist. 

Holstein seeks compensatory damages.
