Drunk Driver Settles with Injuried Motorist

The Plaintiff, Dominic Bess and his friend, the Defendant Chadwick Winn were out drinking together on the eve of Thanksgiving in Moncks Corner, South Carolina. They left the drinking establishment in separate vehicles and were traveling on Highway 52 when they collided with one another. Mr. Bess had been traveling in the left lane when Mr. Winn came up beside Mr. Bess in the right lane and side-swiped his passengers side. The defendant’s car left the road and was totaled. Mr. Winn was seriously injured and was in a coma for a long period of time. Mr. Winn was charged with a DUI while the Plaintiff passed a preliminary field sobriety test at the scene.

Mr. Bess claimed a minor head injury and multiple soft tissue injuries as a direct result of the accident. He sought chiropractic treatment with physical therapy. Mr. Bess claimed $1,900 in past medical bills. Mr. Winn denied liability for the accident and filed a counterclaim. The defendant argued that the plaintiff cut off his lane of travel.

The settlement was reached which gave Mr. Bess the amount of $6,250 on August 2, 2010.
