Couple Files Suit Against FedEx And Driver

A couple has filed suit against FedEx Freight Systems and one of its employees for the personal injuries they suffered in an automobile accident.

According to the suit they filed in West Virginia’s Putnam County Circuit Court, Anthony and Elaine Musarra were pulling into the parking lot of a Go-Mart located in Hurricane, West Virginia when Roger Pauley, who was employed by FedEx and driving a tractor trailer, was exiting the parking lot.

The suit says that as Pauley was leaving, the top of the tractor-trailer hit telephone and electrical lines, pulling the lines and pokes onto the parking lot.

The Musarras say the lines wrapped around the right front tire of their vehicle, causing it to be pushed sideways, tip approximately 30 inches from the pavement, and be jerked back to the right upright position.

The suit claims that FedEx is liable for its employee’s careless, reckless, and negligent conduct.
