Tomas Gonzalez Gallardo of Autryville was charged with misdemeanor death by motor vehicle and stop sign violation stemming from an accident last Sunday on Hayes Mill Rd.
According to a report, N.C. Highway Patrol investigators stated the failure to use seat belts was a factor in the accident.
This is the third death on county roads in the last two weeks.
Gallardo was driving a 1998 Ford pickup, in which a relative, Nicomedes Sanchez of the same address as Gallardo was a passenger.
The pickup was traveling east on Hayes Mill Road and failed to stop at a stop sign. The pickup drove through the intersection at Tew Road and collided with a GMC sport utility vehicle.
The SUV driven by Joy McLamb Spell of Autryville was hit in the left front quarter panel.
Upon impact, Sanchez was thrown from the pickup and died from his injuries.
Spell’s SUV was knocked off the roadway and struck a tree.
Gallardo was transported to Sampson Regional Medical Center and treated for his injuries.
Spell was transported to Betsy Johnson Hospital and later transferred to WakeMed.
