Breast Injuries Garner Award for Driver

The plaintiff Wendy Clark was driving her vehicle with the right-of-way when she T-boned the defendant Charles Keever in Morganton, North Carolina. Mr. Keever admittedly drove out in front of Ms. Clark’s vehicle from a private drive. She claimed deep tissue bruising from the accident.

Ms. Clark alleged that she sustained serious injuries as a direct result of this accident. She presented a testimony from her treating physicians who opined that her breast injuries arose from the accident.

Mr. Keever said that this accident might not have caused all Ms. Clark’s injuries, which could have been related to another event. The alleged injuries were deep soft tissue bruising to the breasts from plaintiff’s seat belt. Ms. Clark sought past medical bills, lost wages and damages for pain and suffering.

On December 28, 2009 the jury returned a verdict of $9,500, plus costs of $8,500 for a total of approximately $18,000.
