$110,000 Verdict Against Hospital for Failure to Return Fetus Remains
The remains of a fetus were not returned to Plaintiffs so they can arrange a proper funeral, per their Muslim believes. The claim was filed against the hospital and mid-wife by the parents of the fetus for depressive disorder and post-traumatic stress disorder. The claim on behalf of the wife was dropped due to lack of evidence in damages. It was found that there was no negligence proven on behalf of the midwife, but the jury returned a verdict against the hospital in the amount of $110,000.00.
